Surat Kepala BKN Nomor K.26-30/V.72-2/99

Menindaklanjuti mengenai enam kegiatan ujaran kebencian berkategori pelanggaran disiplin Aparatur Sipil Negara (ASN), Kepala Badan Kepegawaian Negara (BKN) Bima Haria Wibisana mengeluarkan Surat Kepala BKN Nomor K.26-30/V.72-2/99.  Bima menegaskan PNS sebagai perekat dan pemersatu bangsa, menjaga situasi serta kondisi yang tertib dalam melaksanakan tugas.

Melaui surat edaran itu juga, Bima menghimbau kepada seluruh Pejabat Pembina Kepegawaian (PPK) Instansi Pusat dan Daerah untuk membina dan mengawasi seluruh PNS termasuk Calon PNS di lingkungannya biar tetap menjaga integritas, loyalitas, dan berpegang teguh pada 4 (empat) pilar kebangsaan yaitu Pancasila, Undang-undang Dasar Negara Republik Indonesia Tahun 1945, Bhinneka Tunggal Ika dan Negara Kesatuan Republik Indonesia.  Serta memberikan adanya larangan menyebarluaskan gosip yang berisi ujaran kebencian mengenai suku, agama, ras dan antargolongan (SARA). 

Dalam Poin b Surat Kepala BKN Nomor K.26-30/V.72-2/99 selain menegasakan  bahwa PNS (ASN) dihentikan memberikan ujaran kebencian juga mempersembahkan teladan pelanggaran disiplin terkait larangan ujaran kebencian termasuk jenis hukuman yang sanggup dikenakan. Berikut ini kutipannya:

1) Seluruh Pejabat Pembina Kepegawaian Instansi Pusat dan Pejabat Pembina Kepegawalan Instansi Daerah dihimbau untuk membina PNS di Iingkungannya biar bekerja sesuai dengan kiprah dan fungsi masing-masing dan peka terhadap pewbahan situasi dan kondisi di lingkungannya yang mengarah pada terjadinya potensi konflik sosial.

2) Seluruh Pejabat Pembina Kepegawaian Instansi Pusat dan Pejabat Pembina Kepegawaian Instansi Daerah diminta untuk memberikan kepada PNS di lingkungannya adanya larangan menyebartuaskan gosip yang berisi ujaran kebenciari terkait dengan suku, agama, ras, dan antargolongan (SARA).

3) Seluruh Pejabat Pembina Kepegawaian Instansi Pusat dan Pejabat Pembina Kepegawalan Instansi Daerah biar membina dan mengawasi seluruh PNS di lingkungannya biar tetap menjaga integritas, loyalitas, dan berpegang teguh pada 4 (empat) pilar kebangsaan yaltu Pancasila, UUD Negara Republik Indonesia Tahun 1945, Bhinneka Tunggal Ika, dan Negara Kesatuan Republik Indonesia (NKRI).

4) Dalam hal terjadi indikasi adanya kegiatan dan kegiatan yang mengarah atau berpotensi mengganggu ketertiban dan dalam pelaksanaan kiprah di Iingkungannya, harus ditindaklanjuti dengan melaksanakan pemanggilan dan pemenksaan sesuai dengan ketentuan peraturan perundang-undangan.

5) PNS yang terbukti menyebarluaskan gosip hoax yang bermuatan ujaran kebencian terkait dengan suku, agama, ras, dan antargolongan (SARA) adalah suatu pelanggaran disiplin dan dijatuhi eksekusi disiplin sesuai dengan ketentuan peraturan perundang-undangan.

6) Pelanggaran disiplin ibarat yang dimaksud pada angka 5) antara lain berupa:
a) Menyampaikan pendapat di muka umum baik secara mulut maupun tertulis, yang dilakukan secara eksklusif maupun melalui media umum atau media lainnya ibarat spanduk, poster, baliho yang bermuatan ujaran kebencian terhadap Pancasila, UUD Negara Republik Indonesia Tahun 1945, Bhinneka Tunggal Ika, dan Negara Kesatuan Republik Indonesia (NKRI) serta Pemerintah.
b) Menyampaikan pendapat di muka umum baik secara mulut maupun tertulis, yang dilakukan secara Iangsung maupun melalui media umum atau media lainnya ibarat spanduk, poster, baliho yang bermuatan ujaran kebencian terhadap salah satu suku, agama, ras, dan antargolongan (SARA).
c) Menyebarluaskan pendapat yang bermuatan ujaran kebencian ibarat yang dimaksud pada karakter a) dan karakter b) baik secara eksklusif maupun melalui media umum (share, broadcast, upload, retweet, regram, dan sejenisnya).
d) Mengadakan kegiatan yang mengarah pada perbuatan menghina, menghasut, memprovokasi, dan membenci Pancasila, UUD Negara Republik Indonesia Tahun 1945, Bhinneka Tunggal Ika, dan Negara Kesatuan Republik Indonesia (NKRI) serta Pemerintah.
e) Mengikuti atau menghadiri kegiatan yang mengarah pada perbuatan menghina, menghasut, memprovokasi, dan membenci Pancasila, UUD Negara Republik Indonesia Tahun 1945, Bhlnneka Tunggal Ika, dan Negara Kesatuan Republik Indonesia (NKRI) serta Pemerintah.
f) Menanggapi atau mendukung sebagai tanda baiklah pendapat ibarat yang dimaksud pada karakter a) dan karakter b) dengan mempersembahkan likes, love, retweet, regram, atau comment di media sosial.

7) Pelanggaran ibarat yang dimaksud pada karakter a), karakter b), karakter c), dan karakter d) dijatuhi eksekusi disiplin berat dengan mempertimbangkan latar belakang dan imbas perbuatan, Sedangkan  Pelanggaran ibarat yang dimaksud pada karakter e) dan karakter f) dijatuhi eksekusi disiplin sedang atau ringan dengan mempertimbangkan latar belakang dan imbas perbuatan.
