Surat Edaran Menaker Perihal Pembayaran Thr Tahun 2018

Menteri Ketenagakerjaan (Menaker) Hanif Dhakiri telah menerbitkan Surat Edaran (SE) Menaker Nomor 2 Tahun 2018 wacana Pembayaran Tunijan Hari Raya (THR) Keagamaan Tahun 2018, yang ditujukan kepada para gubernur dan para bupati atau wali kota se-Indonesia pada 8 Mei 2018. Dalam SE Menaker Nomor 2 Tahun 2018  itu disebutkan, pinjaman THR Keagamaan bagi pekerja atau buruh ialah ialah upaya untuk memenuhi kebutuhan pekerja dan keluarganya dalam merayakan hari raya keagamaan.





Berdasarkan SE Menaker Nomor 2 Tahun 2018, dinyatakan bahwa  THR buruh  diberikan kepada:
a. Pekerja atau buruh yang telah memiliki masa kerja satu bulan secara terus-menerus atau lebih;
b. Pekerja atau buruh yang mempunya kekerabatan kerja dengan pengusaha menurut perjanjian kerja waktu tidak tertentu atau perjanjian kerja waktu tertentu.

Adapun besaran THR Keagamaan adalah:
a. Bagi pekerja atau buruh yang memiliki masa kerja 12 bulan secara terus-menerus atau lebih, diberikan sebesar satu bulan upah;
b. Bagi pekerja atau buruh yang memiliki masa kerja satu bulan secara terus-menerus tetapi kurang dari 12 bulan, diberikan THR 2018 secara proporsional sesuai dengan perhitungan: masa kerja/12 bulan x 1 bulan upah.

Bagi pekerja atau buruh yang menurut perjanjian kerja harian lepas, upah satu bulan dihitung sebagai berikut:
a. Pekerja atau buruh yang memiliki masa kerja 12 bulan atau lebih, upah satu bulan dihitung menurut rata-rata upah yang diterima dalam 12 bulan terakhir sebelum hari raya keagamaan;
b. Pekerja atau buruh yang memiliki masa kerja kurang dari 12 bulan, upah satu bulan dihitung menurut rata-rata upah yang diterima tiap bulan selama masa kerja.

Selanjutnya dinyatakan pula bahwa bagi perusahaan yang telah tetapkan besaran nilai THR Keagamaan dalam perjanjian kerja, peraturan perusahaan, perjanjian kerja bersama, atau kebiasaan lebih besar dari nilai THR Keagamaan menyerupai yang dimaksud, maka THR Kegamaan yang dibayarkan kepada pekerja sesuai dengan dalam perjanjian kerja, peraturan perusahaan, perjanjian kerja bersama, atau kebisaan yang telah dilakukan.

Dalam Surat Edaran Menaker Menaker Nomor 2 Tahun wacana Pembayaran THR Tahun 2018 juga ditegaskan bahwa THR Wajib dibayar 7 Hari Sebelum Hari Raya. Pemberian THR paling sedikit sekali dalam satu tahun yang pembayarannya diubahsuaikan dengan hari raya keagamaan masing-masing pekerja atau buruh.
